Dear Friend of Hip Hop Culture:

We invite you to become a member of one of the most unique and innovative organizations in the world, The Universal Federation for the Preservation of Hip Hop Culture, Inc. devoted exclusively to promoting, strengthening and preserving Hip Hop culture throughout the world.

Established in New York City in 2003 as a nonprofit, tax-exempt organization, the mission of the Universal Federation for the Preservation of Hip Hop Culture is:  To preserve Hip Hop culture and provide instruction on the ramifications, significance, social history, and placement of Hip Hop culture

The Federation is the nation’s first nonprofit organization which includes the actual inventors of Hip Hop music and culture.  Our members include Afrika Bambaataa, GrandMaster Caz, GrandMaster Melle Mel, Lovebug Starski, among others.

Our immediate goal is to create the National Center for the Study and Preservation of Hip Hop Culture.  This multi-million dollar, state of the art Center, will be located in the Bronx—the birthplace of Hip Hop.  The Center will house the archives of the chronological evolution of Hip Hop music through the preservation of documents, artifacts, musical compositions, collections, artist biographical information and other memorabilia.  Simultaneously, an educational program will be developed to serve as an international place of study.

If you believe in and share our mission, if you are seeking an avenue to meet and interact with others who share that mission, if you want to be a part of something bigger than yourself, then join us. You will be an important part of an historical movement to preserve the 30+-year of Hip Hop culture.

Who Can Become a Member?

All individuals, public and private organizations, businesses, corporations and foundations are eligible to become members of the Universal Federation for the Preservation of Hip Hop Culture provided they subscribe to the mission of the Center, meet any additional qualifications adopted from time to time by the organization’s board of directors, and pay an annual membership fee determined by the board of directors.

Types of Membership

  • Full Membership - open to any individual who meets the above criteria.
  • Associate Membership - open only to students pursuing full-time undergraduate or graduate work, high school students, retirees or others for whom the financial burden of full membership may be prohibitive.
  • Institutional Membership - open to any public, private association, organization or institution, business corporation or foundation who meet the previously stated criteria.

All memberships are non-voting.

Cost of Membership

All Members must pay an annual membership fee which will be valid for one year or other specified time period from receipt of payment. Current membership fees, which are tax-deductible, are as follows:

  • Full Members $75
  • Associate Members $50
  • Student Members $20

Institutional Members with:

  • annual budgets of $100,000 or less - $200
  • with annual budgets of between $101,000 and $499,000 - $350
  • with annual budgets of between $500,000 and $1,000,000 - $500
  • with annual budgets of over $1,000,000 - $1,000

    Co-founded by Jorge "Pop Master Fabel" Pabon and Christie Z-Pabon, Tools of War was named with the idea that there are many "tools" one can use in competing/battling within Hip Hop culture: turntables, microphones, paint, one's body, and especially one's voice (and so on)! Although the name might appear aggressive, the intent behind it's use is actually to inform and educate people regarding not only Hip Hop but many other social and political issues. As we grow, we are finding that it has also become a forum for voicing opinions and sharing ideas which might help in unifying and uplifting people all over the world.

    KING (OR QUEEN) OF THE BEAT PRODUCER BATTLE
    King of the Beat FR

    The King (or Queen) of the Beat Producer Battle debuted in June 2002 at CBGB's Gallery in Manhattan. The venue was packed! Jazzy Jay came up with the unique concept and I (Christie Z) coordinated the battle. We held it in association with Oscar Poche and Sonny of Media Music Expo.

    Looking up to the balcony at judges Diamond D, Lord Finesse, DJ Premier, Hank Shocklee, RockLogic and Steve Dee, I couldn't believe that we really had such a prestigious who's who of beat makers and jugglers judging our battle! Even 45 King offered to judge but ended up not being able to make it on the day of.

    To this day, Lord Finesse swears he wont judge another beat battle but ours. He's been a big advocate of bringing the battle back and touring it nationally and internationally.

    Kane from Brooklyn was crowned the King of the Beat by the end of the day with DJ Lenn Swann, in all the way from Detroit just for this battle, as runner up.

    DJs Shabazz, Lord Finesse and GrandWizzard Theodore rocked amazing DJ sets that day. The Original Jazzy Jay served as host. This was when we realized that he was a natural on the mic! Fabel has it all on film.

    Jazzy's concept for the King (or Queen) of the Beat battle is that everyone has to perform over the beat, in whatever way. You can't just load your beat and bob your head - you gotta work! Lenn Swann plugged a guitar into the mixer and played funky bass lines over his beat. Battle DJs had an advantage of course since the turntables were right there to use. One was only limited by the equipment or instruments that he/she didn't know how to use.

    In bringing up the glory and excitement of our debut producer battle, Jazzy and I are letting everone know that we never gave up trying to tour this battle, sponsors especially can attest to this! Please keep an eye out for future tour dates and don't let any imitators and duplicators get it confused!

    Tools of War was named with the idea that there are many "tools" one can use in competing/battling within Hip Hop culture: turntables, microphones, paint, one's body, and especially one's voice (and so on)! Although the name might appear aggressive, the intent behind it's use is actually to inform and educate people regarding not only Hip Hop but many other social and political issues. As we grow, we are finding that it has also become a forum for voicing opinions and sharing ideas which might help in unifying and uplifting people all over the world.

    Can we just say that El Puente High School in Brooklyn is the most awesome high school ever? Fabel & I attended the "EL PUENTE CELEBRATES 10 YEARS OF HIP HOP - A TOOL FOR LIBERATION" event on Friday. The youth there were so full of energy, knowledgable on Hip Hop culture and activism! Fabel was presented with a lifetime achievement award which a student made - it was big gold heavy trophy of a hand grasping a microphone. Thanks for inviting us, Kuttin Kandi! Kool Herc was also there to accept this same special award. Students performed as well as known artists like Universes, Rostarr, Breaks Kru, DJ Boo and so many more! Artists rhymed in English and Spanish. Students sang along and went bonkers for all of the performers, esp. their classmates and former alumni. The 2 youth hosts were hysterical. There was just so much enthusiasm, support and energy - it was unbelievable! El Puente has the kind of audience that everyone wishes for. Plus they have cool heads like J-Love, Kuttin Kandi, Edgardo, Kom & Waak down with their program!

    "El Puente's collective spirit is proof of Hip Hop culture's ability to educate, unify and uplift.

    This year marks the 5th Anniversary of the Hip-Hop Theater Festival in New
    York City.  This year’s festival lands in NYC for ONE WEEK ONLY, June 11th –
    June 18th and features the US premieres of two productions by acclaimed
    international artists: from the UK, popper Benji Reid in 13 Mics and from Germany,
    b-boy Niels “Storm” Robitzky in Solo For Two.


    This year the festival will highlight work developed throughout the year
    during HHTF’s “Critical Breaks” Workshop series and OPENING NIGHT will invite the
    “best of” HHTF back the to the stage.  From solo works to ensemble pieces,
    HHTF unites the best of both emerging and established Hip-Hop artists from
    around the country in an arena that stretches the limits of theater, dance, spoken
    word and live music.  Hits from past festivals include: Will Power’s Flow,
    Sarah Jones’ Surface Transit,
    Jonzi D.’s Lyrical Fearta and Ben Snyder’s In Case You Forget.


    Over the past five years, the Hip-Hop Theater Festival has grown from a
    fledgling project of Caseroc Productions and Hip Hop Theatre Junction into an
    independent non-profit organization with a national scope.  HHTF seeks to bring
    audiences and artists from the Hip-Hop generation together with traditional
    mainstream theater audiences.  HHTF's mission is threefold: to invigorate the
    fields of Hip-Hop and theater by nurturing the creation of innovative work within
    the Hip-Hop aesthetic; to present and tour American and international artists
    whose work addresses the issues relevant to the Hip-Hop generation; and to
    serve young urban communities through outreach & education celebrating
    contemporary language and culture.

    "Campaign Against Racial Profiling" Achieves Success in Tennessee

    The Tennessee House and Senate recently passed a bill to study racial profiling. The bill requires Tennessee Highway Patrol officers to collect data for each traffic stop they make.

    "Data collection takes the racial profiling debate beyond accusations and denials by enabling systematic monitoring of Tennessee highways,” said Hedy Weinberg, Executive Director of the ACLU of Tennessee.

    The type of data collected includes race, ethnicity, gender and age of the person stopped, the reason for the stop, and whether a search occurred and a citation was issued. The data will be collected for one year, beginning January 2006.

    Federal Court Strikes Down Nebraska Law Banning Protections for Same-Sex Couples

    In a ruling issued last week, a federal court struck down Nebraska's anti-gay union constitutional amendment that bans any and all forms of legal recognition for same-sex relationships, including domestic partnerships and other basic protections. The state is expected to appeal the case to the U.S. Court of Appeals for the 8th Circuit.

    The Court noted in its ruling that the plaintiffs in the case had not requested any recognition of their relationships through marriage or any other legal status, but merely sought an equal opportunity to persuade legislators of the need for protections. Judge Joseph F. Bataillon went on to say, "The court finds Section 29 is a denial of access to one of our most fundamental sources of protection, the government. Such broad exclusion from 'an almost limitless number of transactions and endeavors that constitute ordinary civil life in a free society' is 'itself a denial of equal protections in the literal sense.'"

    An historic, pivotal battle over the Patriot Act is now underway. This summer, America will need your help as never before, as we work to restore liberties lost to the Patriot Act, and to stem the tide of further expansions.

     

    Take Action!
    Act now and urge your members of Congress to oppose expansion of the Patriot Act.
    We have already begun to fight. With your help, the ACLU won a small victory this week when the Senate Intelligence Committee reversed its decision to vote on legislation to expand the Patriot Act in secret session without any public hearing. And while they did hold a public hearing on Tuesday, the Committee will still be voting on the legislation in a closed door session today.

    If we are going to beat back this climate of secrecy and slow the rush to eliminate checks and balances, we will need to work tirelessly and together as Patriot Act legislation makes its way through Congress this summer.

    Proposed expansions to the Patriot Act include new FBI powers to order disclosure of a broad array of personal records without judicial approval in advance. Another provision would broaden the government’s ability to monitor your mail.

    Not surprisingly, the sponsors of these attacks on liberty are deploying the same tactics used in the 45 days after September 11, 2001, when the Patriot Act was rushed through Congress with little to no debate.

    You have helped the ACLU educate and rally millions of Americans who now realize that the Patriot Act went too far, too fast. We’ve been successful in generating a growing clamor of bipartisan concern over the Patriot Act. The time to make our voices heard is now.

    In the coming weeks, we will keep you informed of developments in Congress and our essential efforts to make sure the Patriot Act receives real reform, not a rubber stamp.

    Title 2

    Documents released last week by the Department of Defense reveal more cases of abuse of detainees, including mock executions and use of a religious symbol to taunt detainees.

    "While the White House blames Newsweek magazine for damaging America's reputation in the Muslim world, the Army's own investigations show systemic abuse and humiliation of Muslim men by U.S. forces in Iraq, Afghanistan and Guantánamo Bay," said ACLU Executive Director Anthony D. Romero. "If we are to truly repair America's standing, the Bush Administration must first hold accountable high-ranking officials who allow the continuing abuse and torture of detainees."

    One investigation into abuses at Rifles Base in Ramadi, Iraq details an incident in July 2003 in which an Army captain took an Iraqi welder into the desert, told him to dig his own grave, verbally threatened to kill him and had other soldiers stage a shooting of the man.

    Another document dated July 15, 2004 related an incident involving two Iraqi men detained in Samarra. The men were driven to a bridge, where a platoon leader instructed three soldiers to push the detainees into the river. One of the Iraqi men could not swim and drowned. The body was recovered by the family 12 days later and buried. One soldier indicated to investigators that the chain of command had instructed the soldiers not to cooperate with the investigation and to deny that they pushed the men into the river.

    To date, more than 35,000 pages of government documents have been released in response to the ACLU's Freedom of Information Act lawsuit. The ACLU has been posting these documents online at www.aclu.org/torturefoia.


     

    Title 3

    The FBI and local police are engaging in intimidation based on political association and are improperly investigating law-abiding human rights and advocacy groups, according to documents obtained by the ACLU through a series of Freedom of Information Act (FOIA) requests filed last week.

    The ACLU charged that the FBI is wrongfully withholding thousands of pages of documents, and filed a lawsuit on May 18 in federal court to compel the FBI to comply with the FOIA requests. The few documents received to date through the December FOIA requests shed light on the FBI’s misuse of Joint Terrorism Task Forces (JTTFs) to engage in political surveillance.

    The FOIAs seek two kinds of information: the actual FBI files of groups and individuals targeted for speaking out; and information about how the practices and funding structure of the JTTFs may be encouraging rampant and unwarranted spying.

    "The FBI is taking tax dollars and resources established to fight terrorism and instead spying on innocent Americans who have done nothing more than speak out or practice their faith," Beeson said. "By recruiting the local police into these activities, they are also sowing dissent and suspicion in communities around the country."

    The JTTF partnerships between the FBI and local police, in which local officers are "deputized" as federal agents, are intended to identify and monitor individuals and groups implicated in terrorism. But the ACLU charges that these task forces are allowing local police officers to target peaceful political and religious groups with no connection to terrorism.

    Over the past three years, the federal government has awarded more than one million dollars to the "Silver Ring Thing," an abstinence-only organization that describes its mission as "offering a personal relationship with Jesus Christ as the best way to live a sexually pure life."

    Last week, in response to a lawsuit filed by the ACLU and Jenner & Block LLP against the federal government for funding religious activities in an abstinence-only program, the Silver Ring Thing substantially altered and removed religious content from its website.

    During the "Silver Ring Thing's" flagship three-hour program members testify about how accepting Jesus Christ improved their lives, quote Bible passages, and urge audience members to ask the Lord Jesus Christ to come into their lives. In addition, the official silver ring of the program is inscribed with a reference to the biblical verse "1 Thess. 4:3-4," which reads "God wants you to be holy, so you should keep clear of all sexual sin. Then each of you will control your body and live in holiness and honor."

    The "Silver Ring Thing" is an extensive, nationwide effort that uses government funds for aggressive religious recruitment. Since April 2003, it has held three events in the Boston area and is scheduled to hold a fourth in October of this year. But, it has also held events in Alabama, Connecticut, Florida, Michigan, Minnesota, Pennsylvania, South Carolina, Tennessee, Texas, West Virginia, and Wisconsin and is scheduled to visit Georgia, Ohio, and North Carolina, among other states, in the coming year.

    "A sanitized version of the website does not change the fact that the "Silver Ring Thing" in its core programming is nothing more than a vehicle for converting young people to Christianity," said Sarah Wunsch, a staff attorney at the ACLU of Massachusetts. "Taxpayer dollars should play no part in such a program."

    Lesbian Challenges Missouri Policy Barring Gay People from Foster Parenting

    A lesbian who has spent her life helping children is challenging a Missouri policy barring lesbian and gay people from serving as foster parents. Represented by the ACLU, Lisa Johnston is challenging the policy in state court after an administrative judge denied her application solely because she is a lesbian.

    Johnston has a deep commitment to helping children -- in her current job with Head Start, she consults with childcare homes on developmentally appropriate curricula. In 2003, she applied to the Department of Social Services (DSS) to become a foster parent to a child that she and her partner hoped to raise together. After completing seven of nine foster-parent training sessions, DSS notified Johnston that because she is a lesbian, it would no longer consider her for placement.

    Johnston appealed the decision, and although the administrative judge found her "exceptionally" qualified to foster parent, he denied her application in March 2005 solely because of her sexual orientation. On April 8, the ACLU filed a petition in the Jackson County Circuit Court asking the court to review the order from DSS. The ACLU charges that DSS's decision banning Johnston from foster parenting is illegal.

    Under Missouri law, every potential foster parent is already required to undergo strict screening before being qualified to foster parent. Categorical bans like the one enacted by DSS don't protect children, but merely unnecessarily disqualify people who could be good parents.

    New D.C. Law Protects Protest Rights

    The D.C. City Council has approved a new law that strengthens the First Amendment rights of peaceful protesters and limits police use of "protest pens" and mass arrests.

    The "First Amendment Rights and Police Practices Act of 2004" declares that people have a right to demonstrate "near the object of their protest so they may be seen and heard," and makes clear that people do not need police permission to exercise their constitutional right to freedom of speech. The law also prohibits police from arresting an entire assembly when only a few people are breaking the law, requires police to display visible identification when handling demonstrations, restricts the use of police lines to entrap demonstrators who have not broken any law, and prohibits the use of tear gas and pepper spray on peaceful protesters.

    Title 1

    The Real ID Act, which sets the stage for a national ID card system, will probably be enacted without any hearings or debate because Congress attached the controversial measure to the appropriations bill that includes funding for military operations.

    The legislation also rolls back asylum laws and attacks immigrants. "The Real ID Act was sold as an illegal-immigration fix bill, when in fact it reduces every American's freedom," said Timothy Sparapani, an ACLU Legislative Counsel. "The provisions of this bill could not have passed on their own. Sadly, their inclusion in a 'must pass' bill means that immigrants and citizens alike will face an unnecessary loss of freedom and privacy."

    "The federalization of drivers' licenses, and the culling of all information into massive databases, creates a system ripe for identity theft," Sparapani said. "New standards could place our most private information - including photographs, address and social security numbers - into the hands of identity thieves."

    The House passed the underlying measure last week; the Senate is expected to vote this week.

    By passing this bill -- the REAL ID Act -- Congress created a national ID system and failed to protect your privacy.

    Title 3

    The U.S. Court of Appeals last week upheld the dismissal of FBI whistleblower Sibel Edmonds' case, despite a Justice Department report saying that Edmonds' whistleblower allegations were "the most significant factor" in the FBI's decision to terminate her.

    Edmonds, a former Middle Eastern language specialist hired by the FBI shortly after 9/11, was fired in 2002 after repeatedly reporting serious security breaches and misconduct. Edmonds challenged her retaliatory dismissal by filing a federal lawsuit, but her case was dismissed last July after Attorney General John Ashcroft invoked the so-called "state secrets privilege" and retroactively classified briefings to Congress related to her case. The state secrets privilege has historically been rarely invoked, and even more rarely employed to dismiss an entire case at the outset. When properly invoked, it permits the government to block disclosure of evidence that would cause harm to national security. In the Edmonds case, however, the government used the privilege to urge dismissal of the entire lawsuit, insisting that every aspect of Edmonds' case involves state secrets - including where she was born and what languages she speaks.

    "This decision endangers us all. If government employees cannot report security breaches without retaliation, then national security, and all Americans, suffer," said Ann Beeson, Associate Legal Director of the ACLU, who argued the case on behalf of Edmonds. "We are determined to take this case all the way to the Supreme Court."

    Title 4

    Lawmakers met last week to examine sections of the Patriot Act, including section 213, which authorizes "sneak and peek" searches, permitting unlimited delayed notification to the targets of search warrants. These warrants are available in all criminal cases where the federal government says notification would result in destruction of evidence, danger, flight from prosecution, intimidation of a witness, or serious jeopardy to a criminal investigation. The ACLU has long argued that this catch-all "serious jeopardy" clause is too broad and must be narrowly curtailed.

    When the Patriot Act was passed, Congress made sure some of the most extreme powers would "sunset" this year unless Congress reauthorized them. While "sneak and peek" is not one of them, the ACLU and its allies have called for Congress to modify this power to ensure that proper checks are put into place.

    In July 2003, the House adopted - by an extraordinary margin - an amendment that would bar federal law enforcement from implementing "sneak and peek" search warrants. Rep. C.L. "Butch" Otter (R-ID), along with bipartisan allies in both chambers of Congress, has introduced the "Security and Freedom Enhancement Act." The measure would make corrections to the Patriot Act - including section 213 - to bring it back in line with the Constitution.

    Title 5

    In a stunning act of hypocrisy and chutzpah, the government has claimed that turning over Iraq torture photos would violate the Geneva Conventions. Until now, the Bush Administration has shown only contempt for the Geneva Conventions, and it has built its policies dismissing the application of international humanitarian law.

    "The Geneva Conventions were intended to protect prisoners, not to provide governments with a basis for withholding evidence that prisoners have been maltreated," said ACLU attorney Jameel Jaffer. "It's disgraceful that the Defense Department is attempting to contort the Conventions in this way."

    Through a Freedom of Information Act lawsuit, the ACLU and the NYCLU have sought the release of photographs and videotapes, in addition to documents, that would shed light on the systemic abuse of detainees held by the United States overseas. The Defense Department has refused, stating that it would violate the government's obligations under the Geneva Conventions.

    The Fight to Stop the Patriot Act Expansion Begins Now
     
    The debate around the Patriot Act is approaching a crucial moment of decision. Will we sit back while the Bush Administration sacrifices our liberty, or will we answer freedom’s call and help Congress bring the Patriot Act in line with the Constitution?

    There are significant flaws in the Patriot Act, flaws that threaten your fundamental freedoms by giving the government the power to access to your medical records, tax records, information about the books you buy or borrow without probable cause, and the power to break into your home and conduct secret searches without telling you for weeks, months, or indefinitely.

    You have an important role to play in the fight.  Your Members of Congress are accountable to you, their constituent.  Many of them know that the Patriot Act needs to be fixed, not expanded.  And if they have the courage of their convictions, they won’t give in to this latest Bush Administration power grab.  But they’ve got to hear from every American who knows that the Patriot Act erodes our fundamental privacy and due process rights.

    Defend the Constitution and your own fundamental freedoms by urging Congress to reject an expansion of the Patriot Act.
     
    In the coming weeks we’ll be asking for your help to stop these efforts to increase secret government surveillance and search powers.  The Patriot Act imposes restrictions on your privacy  that no democratic and free society  should  tolerate.     Victory: Striking Down Death Penalty for Juveniles

    The ACLU welcomed last week's Supreme Court decision in Roper v. Simmons declaring the execution of juveniles in the United States unconstitutional.

    Fewer and fewer states authorize the execution of juveniles. Fewer and fewer juries are willing to impose the death penalty on juveniles. And the rest of the world has long renounced the execution of juveniles as morally and legally unjustifiable.

    Indeed as Justice Kennedy pointed out prior to the ruling the United States stood "alone in a world that has turned its face against the juvenile death penalty." The decision finally acknowledges this broad consensus and also recognizes that the execution of juveniles does not further any legitimate interest in either retribution or deterrence.

    Success: Judge Says Bush Cannot Hold Citizen as Enemy Combatant

    A federal judge ruled that President Bush does not have the power to hold an American citizen as an enemy combatant. The decision by U.S. District Judge Henry F. Floyd, who was appointed to the federal bench by President Bush in 2003, came in the case of Jose Padilla, a U.S. citizen being held in a naval brig in Charleston, S.C.

    "This decision by one of President Bush's own appointees to the bench represents yet another blow to the Administration's misguided belief that it does not have to follow our constitutional traditions in pursuing terrorists,'' said Anthony D. Romero, ACLU Executive Director. "As Judge Floyd recognized in his opinion, President Bush's actions in the Padilla case flout the checks and balances that ensure our democracy and liberty."

    The ACLU and Human Rights First last week filed a lawsuit charging that Defense Secretary Donald Rumsfeld bears direct responsibility for the torture and abuse of detainees in U.S. military custody. This is the first federal court lawsuit to name a top U.S. official in the ongoing torture scandal in Iraq and Afghanistan.

    "Secretary Rumsfeld bears direct and ultimate responsibility for this descent into horror by personally authorizing unlawful interrogation techniques and by abdicating his legal duty to stop torture," said Lucas Guttentag, lead counsel in the lawsuit and director of the ACLU's Immigrants' Rights Project. "He gives lip service to being responsible but has not been held accountable for his actions. This lawsuit puts the blame where it belongs, on the Secretary of Defense."

    The lawsuit was filed in federal court in Illinois on behalf of eight men who were subject to torture and abuse at the hands of U.S. forces under Secretary Rumsfeld's command. The plaintiffs were incarcerated in U.S. detention facilities in Iraq and Afghanistan, where they were subjected to torture and other degrading treatment. None of the men were ever charged with a crime, and all have been released.

    The latest round of investigative files released to the ACLU document an ongoing pattern of widespread abuses of detainees by military forces in Iraq, and describe shootings of unarmed civilians at checkpoints, the ACLU said this week.

    In an unusual move, the Army released approximately 1,200 pages of documents to a select group of reporters late last Friday, along with a press statement and fact sheet purporting to explain the disposition of the incidents. It has not been the Army's practice to release Freedom of Information Act (FOIA) documents directly to the media.

    ACLU Executive Director Anthony D. Romero said that the documents underline the need for an independent special counsel and congressional hearings to investigate the abuses. "Pieces of the puzzle are still missing," Romero said. "An outside special counsel is the only way to ensure that all civilians who violated, or conspired to violate, the laws are held responsible for their crimes."

    While the government did not release the "Ramadi Madness" DVD, claiming that copies had been destroyed, the Palm Beach Post obtained a copy of the video and posted excerpts on its website.

    The ACLU learned from documents unsealed in our National Security Letter case that, in the name of national security, our government sought to black out references in ACLU legal papers to the words "national security" as well as the phrase "I am a Special Agent of the Federal Bureau of Investigation."

    A decision September 2004 by Judge Victor Marrero of the Southern District of New York struck down as unconstitutional a law that permitted the FBI to issue National Security Letters ("NSLs") -- letters that allow the FBI to obtain sensitive customer records from Internet Service Providers and other businesses without judicial oversight.

    The NSL provision is worded so broadly that it could be used to obtain the names of a political organization's members, the names of a journalist's sources, or the names of people who write anonymous "blogs" on the Internet. The provision permitted the FBI to obtain this information without a subpoena or search warrant and without judicial oversight of any kind.

    The September decision also struck down an associated gag provision, saying "an unlimited government warrant to conceal" has no place in our open society. The ruling was the first to strike down a surveillance provision of the Patriot Act. The court has not yet set a schedule for hearing the government's appeal of the ruling.

    The ACLU, the Center for Reproductive Rights, and Planned Parenthood Federation of America asked a federal court to strike down a broad abortion ban that would outlaw virtually all abortions in the state and interfere with a doctor's ability to provide other critical health care services.

    "This radical law goes far beyond any other legislation in the country, threatening women's ability to obtain even a first-trimester abortion and, in some instances, preventing doctors from treating miscarriages," said Rev. Mark Pawlowski, CEO of Planned Parenthood of South Central Michigan, a plaintiff in the lawsuit. "It is part of a larger anti-choice agenda that extends beyond abortion to restricting family planning, access to contraception and women's right to medical privacy."

    The Michigan law is scheduled to take effect on March 30. The three organizations filed a single suit in the U.S. District Court for the Eastern District of Michigan on behalf of reproductive health facilities, obstetrician-gynecologists, and their patients.

    The ACLU is representing Louise Bizzari and Barbara Hackett, two women who were kicked out of a health/rehabilitation center because they are a couple. Louise has osteoarthritis and is in danger of losing her leg unless she can strengthen it and have surgery. On her doctor's advice she went to sign up for aquatic therapy at the Sitrin Health Center in New Hartford, NY. But when she told the Center that the health insurance to pay for the therapy came through her domestic partner, the Center decided it would not accept her insurance. When Louise said she would pay out of pocket, the Center told her she couldn't afford the program and refused to sign her up.

    Louise and Barbara decided to join the Center and simply use the pool during public hours instead of getting aquatic therapy. They wanted, as they put it, "to keep a low profile." But when the Director of Rehabilitation discovered they were using the pool, she "dismissed" them from the Center and had police officers escort Louise out of the building.

    The complaint filed by the ACLU charges that the Sitrin Center illegally discriminated against both Bizzari and Hackett in violation of the Sexual Orientation Non-Discrimination Act, a New York human rights law that protects against sexual orientation discrimination in employment, housing and public accommodations.

    "Unfortunately, this story demonstrates all too painfully the types of indignities that lesbian and gay people face every day in this country," said Barrie Gewanter, Executive Director of the Central New York Chapter of the New York Civil Liberties Union. "It took a lot of courage for Louise and Barbara to come forward with this discrimination. I hope this case helps send a very clear message to all businesses in New York that this type of behavior won't be tolerated."

    • Scott Silber is an organizer for the Service Employees International Union and a student activist at Colorado University. Last July, the FBI called Silber and asked him to come to their offices. Documents obtained by the ACLU through the Freedom of Information Act show that Silber was under surveillance as recently as last August.

       
    • Reverend Raymond Payne, a Methodist Minister from Kentucky, was stopped last October by Canadian border officials. They interrogated Rev. Payne for more than an hour as he attempted to enter Canada for a vacation. According to Rev. Payne, the officials informed him that the interrogation was triggered because he was the subject of an FBI file. He has never been arrested, been charged with a crime, or even participated in a protest.
    To protect the freedom of Americans to pursue their right to peaceful protest, the ACLU is conducting a nationwide campaign to expose and limit FBI spying on people and groups simply for speaking out or practicing their faith.

    Newly Released Government Information Could Aid Whistleblowers

    In a revelation that could aid government whistleblowers in their efforts to fight unlawful dismissals, the Justice Department has admitted that information it had retroactively classified could be released to the public and did not pose a threat to national security.

    "The Justice Department's long-overdue admission goes to the core of the ACLU's allegations that the government is going all out to silence whistleblowers to protect itself from political embarrassment," said ACLU Associate Legal Director Ann Beeson, who is representing former FBI translator Sibel Edmonds in a lawsuit challenging her termination. "This is hardly an isolated case, as numerous national security whistleblowers can attest. The government is taking extreme steps to shield itself while gambling with our safety."

    FreedomWire: Where students and young people can get involved



    Army files obtained by the ACLU reveal previously undisclosed allegations of abuse by U.S. soldiers in Iraq and Afghanistan. Among the documents are reports that a detainee who was beaten and seriously injured was forced to drop his claims in order to be released from custody.

    The release of these documents follows a federal court order that directed the Defense Department and other government agencies to comply with a year-old request under the Freedom of Information Act (FOIA) filed by the ACLU, the Center for Constitutional Rights, Physicians for Human Rights, Veterans for Common Sense and Veterans for Peace. The New York Civil Liberties Union is co-counsel in the case.

    One of the recently released files reports that U.S. soldiers in Afghanistan posed for photographs of mock executions with hooded and bound detainees, and that some of these photographs were intentionally destroyed after the Abu Ghraib scandal to avoid "another public outrage."

    "These files provide more evidence, if any were needed, that abuse was not limited to Abu Ghraib," said ACLU staff attorney Jameel Jaffer. "Unfortunately, it's now clear that the government failed to investigate many of these abuses until the Abu Ghraib photographs came to light."

    Attorneys for the ACLU and other organizations named in the lawsuit will appear in federal court in New York on February 25 to address the inadequacy of the government's response to requests for records regarding the treatment of detainees held by the United States at military bases and other detention facilities overseas, including Guantánamo Bay.

    The Supreme Court is expected to hear oral arguments on Tuesday, March 1 over the constitutionality of Ten Commandments displays on government land and buildings in two separate cases, including a successful challenge by the ACLU of Kentucky to a courthouse display.

    "We remain confident that the Kentucky case is firmly in line with the principle that government should not promote religion," said David A. Friedman, General Counsel for the ACLU of Kentucky, who argued the case before the appeals court.

    "The Ten Commandments advocate believing in God, observing the Sabbath and not worshipping idols," Friedman added, noting that different faiths have different versions of the document. "Those are religious beliefs that should be left to each individual. Especially in a courthouse, people should not be made to feel like outsiders in their own community because they may not share the prevailing religious view."

    The Sutter, California based company InCom announced on February 15, 2005 at a packed special school district meeting of the Brittan School Board that it would end its pilot program to require students to wear Radio Frequency Identification (RFID) badges that track the students' movements. The decision came after the ACLU of Northern California and other organizations urged school officials to end the program after being contacted by several parents.

    Sutter resident Dawn Cantrall, who has a child in the 7th grade, added: "We are proud that we stopped it here in Sutter and we will continue to fight to make sure that no child is ever forced to have an RFID badge. As parents, it is our duty to keep our children safe and it is not safe to have tracking devices in student badges."

    Dawn and her husband Michael Cantrall filed a formal complaint against the Brittan Elementary School Board on January 30 after meeting with several school officials. Like other parents, the Cantralls only learned about the program, which was introduced on January 18, when their child came home wearing the tracking device.

    "This is a tremendous victory for the students and families of Sutter," said Nicole Ozer, Technology and Civil Liberties Policy Director of the ACLU of Northern California. "However, this is not just an issue affecting school children. The potential use of RFIDs in other identity documents, such as driver's licenses and medical cards, should be of concern to all Californians. RFIDs in identity documents is an issue that requires a statewide response and we plan to encourage legislative action on this front."

    The City of Omaha and the ACLU of Nebraska reached a settlement in the lawsuit Lubna Hussein v. City of Omaha.

    The lawsuit was filed in June 2004 on behalf of a Muslim woman who was not allowed to enter a public swimming pool last summer due to her religious clothing. The city policies in place at the time of the lawsuit did not permit anyone to enter a swimming pool unless they were wearing a bathing suit. Lubna Hussein came to the pool with her small daughters to watch them swim and did not intend to swim herself. Ms. Hussein observes Muslim dress requirements for women by wearing modest clothing and a head scarf to cover her hair.

    "I am so pleased at this change in policy," said Lubna Hussein. "My little girls have been waiting for a chance to try out the water slides and they'll finally get the opportunity this summer. We're happy to feel like part of the community again."

    In Banda Aceh, Indonesia, the area hardest-hit by the tsunamis, I met UNICEF relief worker Anton Susanto, shown here with Iqbal, a local boy who was separated from his family in the disaster. While UNICEF worked to locate Iqbal's relatives — who have not yet been found — Anton took the frightened boy under his wing. As you can see, Anton's warmth helped Iqbal feel safer and more secure. I'll keep you posted on the youngster's progress toward resuming an ordinary childhood.

    Your generous support during the tsunami crisis  has already made a difference for children and families across South Asia. On behalf of UNICEF, I'm writing to express my deepest gratitude. I'm especially thankful because I saw your donation dollars at work during a recent 10-day trip to the region.

    Despite the terrible human toll of this disaster, I saw hope in the faces of the children I visited, and true heroism in the tireless work of UNICEF's field staff. Small miracles are happening in battered coastal cities and villages throughout the tsunami zone, every hour of every day. And without you, they wouldn't have been possible.

    Rapid Response

    UNICEF colleagues I met in the field repeatedly expressed their sincere thanks for your extraordinary, rapid response to the tsunami crisis.

    By New Year's Eve, just four days after the tsunamis struck, we had received more than $10 million in contributions through our website. That day, we were able to send $6 million to UNICEF field operations in the hardest-hit areas.

    As of today, we have sent $61 million to save children's lives in South Asia, with more help on the way. And I am proud that 95 cents of every one of those dollars will be used to help kids in desperate need.

     



    What UNICEF Is Doing

    Child survival: For more than 1 million children who have survived the tsunami disaster, the key is to keep them alive and healthy.
    • UNICEF is providing safe drinking water, building adequate sanitary facilities in displaced persons' camps and schools, distributing basic hygiene kits and educating families on hygiene and sanitation to prevent waterborne infections.
    • UNICEF is organizing immunization campaigns against deadly childhood diseases in the affected countries, and providing doses of vitamin A to boost children's weakened immune systems.

    Family reunification and child protection: Thousands of children were separated from their families during the tsunamis, leaving them vulnerable and afraid.

    • UNICEF has established centers to register children separated from their families, and is working with partners to trace missing parents or relatives.
    • UNICEF is training teachers and counselors to support children who are psychologically distressed.

    Returning children to school: Over 1,000 schools were damaged or destroyed by the tsunamis, suddenly leaving children without an important, reassuring daily routine.

    • Immediately after the disaster, UNICEF began setting up temporary spaces for children to learn.
    • UNICEF has distributed thousands of "School-in-a-Box" kits containing basic educational materials for use in makeshift classrooms and in schools that have reopened across the region.
